# Introduction to Committee of Adjustment

The Committee of Adjustment is a quasi-judicial board established under Ontario's Planning Act to grant minor zoning variances, approve lot severances, and hear appeals of municipal decisions.

While its authority is limited—restricted to granting relief within existing zoning rather than changing zoning itself—the committee plays a critical role in balancing development needs with community planning objectives through a structured four-test evaluation process.

Understanding the committee's composition, jurisdictional boundaries, and procedural requirements is essential for successful application submissions and favorable outcomes.

## Core Concepts

### What is a Committee of Adjustment?

The Committee of Adjustment serves as a specialized municipal body designed to resolve planning disputes and provide regulatory flexibility. Established under the Planning Act, it operates with quasi-judicial powers, meaning it follows formal legal procedures including evidence presentation, hearing proceedings, and binding decisions.

Unlike traditional courts, the committee does not have full judicial authority; its decisions can be appealed to the Ontario Land Tribunal, but it primarily functions as an administrative adjudicative body focused on specific planning matters.

### Committee Composition and Structure

The committee consists of five to seven members appointed by the municipal council, carefully balanced to ensure diverse expertise and community representation. Typical membership includes planning professionals or building officials, lawyers or individuals with legal backgrounds, and community representatives without specialized technical expertise.

Committee term lengths range from two to four years, with provisions for renewable appointments to maintain continuity while allowing periodic refreshment of leadership. Members select their own chair and vice-chair, who oversee meeting management and procedural adherence throughout the committee's operations.

### Authority and Jurisdiction

The committee possesses defined, limited authority specifically delineated by the Planning Act. It may grant minor variances from zoning requirements when all four statutory tests are satisfied, approve lot severances creating one to three new parcels, and hear appeals of certain municipal decisions such as building permit refusals.

However, its jurisdiction explicitly excludes the power to approve subdivisions involving multiple lots, alter zoning designations, amend the Official Plan, override council decisions, or consider matters beyond its statutory mandate. These boundaries are crucial for applicants seeking clarification on what falls within the committee's scope versus municipal council responsibilities.

### The Four Statutory Tests for Variance Approval

To grant a variance, the committee requires demonstration that all four statutory tests are met, and failure to satisfy any single test results in automatic denial. The first test mandates that the proposed modification remains minor, with deviations typically constrained to ten to thirty percent of standard bylaw requirements. The second test evaluates whether the desired development is appropriate for its location, ensuring compatibility between the proposed use and the character of the surrounding area. The third test ensures that even with a variance, the project maintains the general intent of the zoning bylaw, preventing excessive dilution of land-use goals. Finally, the fourth test requires alignment with the broader intentions of the Official Plan, ensuring that localized changes do not conflict with long-term community planning visions.

### Committee Hearing Process

The hearing procedure follows a standardized sequence designed to ensure fairness, transparency, and thorough examination of each application. Before the hearing, the municipality circulates the application to relevant agencies and notifies the public for comment over a period of ten to fourteen days. At the hearing, the chair opens the session, the applicant presents their case focusing on the four statutory tests, and the committee engages in questioning, agency commentary, and public testimony. After deliberation, the committee votes and typically announces its decision on the same day, with a formal written decision issued shortly thereafter. Successful applicants receive immediate verbal approval, though obtaining a written decision is recommended for documentation purposes.

### Common Misconceptions and Practical Guidance

Applicants often misunderstand the committee's decision-making dynamics, believing that strong community opposition or political connections might influence outcomes. In reality, the committee applies legal criteria uniformly and does not grant variances based on popularity or political favor. Additionally, misconceptions persist regarding the committee's ability to change zoning or guarantee automatic approval for complete applications; while completeness is necessary, the committee must still verify that all four statutory tests are satisfied. Applicants should also understand that variances granting conditions are possible, as is deferring further study when additional information is needed, and that refusing a variance allows the applicant to appeal to the Ontario Land Tribunal within a thirty-day window.

### Appeal Process and Post-Decision Actions

If a variance is denied, applicants may appeal the decision to the Ontario Land Tribunal within thirty days, where an adjudicator reviews whether the committee properly applied the law and whether the four tests were correctly evaluated. Appeals are costly, typically ranging from $5,000 to $15,000 or more due to legal and consulting expenses, and can take four to twelve months to resolve. The tribunal may uphold, overturn, or modify the committee's decision depending on whether legal errors occurred during the original adjudication. Understanding this pathway is vital for applicants who wish to challenge unfavorable rulings while recognizing the financial and temporal investments involved.
