# Queen’s Park Digest — October 2026 Edition

### Executive Summary

The period from Spring → Fall 2026 has been defined by three converging forces

1. Provincial centralization of planning authority
2. Rapid-cycle legislative changes affecting zoning, appeals, and municipal autonomy
3. A new wave of “as-of-right” permissions that override local bylaws

For Toronto and other large municipalities, the October 2026 landscape is one where local bylaws still exist, but their practical power is sharply reduced. The PPS-2024, the Housing Supply Action Plans (HSAP 1–5), and multiple stand-alone bills have created a planning regime where provincial policy is the default, and municipal bylaws must conform quickly or risk being superseded.

#### 1. Provincial Planning Statement (PPS-2024)

**The New Foundation**

The PPS-2024 replaced both the PPS-2020 and the Growth Plan, creating a single, province-wide policy document. Its core effect on municipal bylaws

**A. Intensification is mandatory, not optional**

Municipalities must:

- Permit as-of-right gentle density (triplexes, fourplexes, small walk-ups) in all serviced urban areas.
- Remove zoning barriers that restrict multi-unit housing on “traditional” single-detached lots.
- Demonstrate conformity through updated zoning bylaws, not just Official Plan language.

**B. Minimum density targets are now province-wide**

The PPS-2024 sets:

- Minimum density requirements for major transit station areas (MTSAs)
- Minimum intensification targets for built-up areas
- Minimum greenfield density (higher than previous Growth Plan targets)

Municipal bylaws must be updated to reflect these targets. Failure to do so triggers provincial intervention.

**C. Planning timelines are now enforceable**

Municipalities must process:

- ZBAs within 90 days
- OPAs within 120 days
- Site plans within 60 days

Missed timelines increase the risk of OLT appeals.

#### 2. Housing Supply Action Plan (HSAP)

**Reforms Affecting Bylaws**

Across HSAP 1–5 (2019–2026), several reforms directly alter municipal planning powers.

**A. As-of-right permissions that override local bylaws**

Municipalities must allow:

- Up to 4 units on most residential lots
- Four-storey walk-ups in many urban areas
- Garden suites and laneway suites without discretionary review
- Reduced parking minimums, especially near transit

Local bylaws cannot prohibit these forms. They can only regulate built form, setbacks, and health/safety standards.

**B. Mandatory zoning for MTSAs**

Municipalities must adopt zoning that:

- Permits mid-rise and high-rise densities
- Removes exclusionary height caps
- Reduces or eliminates parking minimums
- Allows mixed-use development

If a municipality fails to adopt MTSA zoning, the Minister may issue a Minister’s Zoning Order (MZO).

**C. Streamlined site plan control**

Site plan control is now:

- Narrower (design details removed from review)
- Faster (60‑day deadline)
- Less discretionary (fewer subjective criteria)

This weakens municipal ability to negotiate design changes.

#### 3. Minister’s Zoning Orders (MZOs)

**Expanded Use in 2026**

MZOs remain one of the most powerful provincial tools. In 2026, their use has expanded in three ways

**A. “Enhanced MZOs” for provincial priorities**

These override:

- Zoning
- Official Plans
- Secondary Plans
- Heritage protections
- Environmental constraints (with conditions)

**B. MZOs for transit‑oriented communities (TOCs)**

TOC sites receive:

- Height and density permissions
- Accelerated approvals
- Reduced municipal negotiation windows

**C. MZOs for “provincial interest” housing**

The province has used MZOs to:

- Permit large‑scale rental projects
- Override municipal height limits
- Accelerate redevelopment of underutilized parcels

Municipal bylaws are effectively suspended on MZO lands.

#### 4. Municipal Bylaw Changes Required by October 2026

Municipalities must update bylaws to comply with PPS-2024 and HSAP reforms. The most common required changes

**A. Residential permissions**

- Allow 3–4 units on all serviced lots
- Permit small multi‑unit buildings (up to 4 storeys)
- Remove minimum lot size requirements
- Reduce parking minimums to near‑zero in transit areas

**B. Intensification & density**

- Upzone MTSAs to mid/high‑rise
- Permit mixed‑use in more areas
- Increase height permissions along transit corridors
- Allow higher FSI (floor space index) in urban neighbourhoods

**C. Process & timelines**

- Update site plan bylaws to reflect narrower scope
- Update zoning bylaws to meet provincial timelines
- Remove discretionary design criteria

**D. Heritage & environmental overlays**

Municipalities must ensure overlays do not:

- Block intensification
- Prevent multi‑unit housing
- Create de facto exclusionary zoning

#### 5. The OLT--A More Powerful Arbiter in 2026

The Ontario Land Tribunal (OLT) has become the primary venue for resolving planning disputes.

**Key changes affecting municipal bylaws**

- Shorter appeal windows
- More deference to provincial policy
- Less weight given to municipal council decisions
- Faster hearing timelines
- Greater ability to impose zoning permissions

Municipalities that fail to update bylaws risk:

- Losing appeals
- Having zoning rewritten by the OLT
- Facing developer‑led “non‑decision” appeals

#### 6. What’s Allowed on Typical Lots (October 2026)

Across most Ontario municipalities, a “typical lot” (serviced, urban, non‑hazard) must now allow

**As‑of‑right**

- Up to 4 residential units
- Garden suites / laneway suites
- Four‑storey walk‑ups (in many areas)
- Reduced parking minimums
- Secondary suites with independent entrances
- Multi‑unit conversions of existing houses
- Mixed‑use permissions near transit

**Subject to form‑based controls**

- Setbacks
- Height limits (unless overridden by MTSA rules)
- Lot coverage
- Landscaping
- Health/safety standards

**Cannot be used to prohibit**

- Multi‑unit housing
- Gentle density
- Intensification
- Rental housing
- Affordable housing forms

#### 7. Strategic Implications for Your Coalition

Given your Toronto‑based planning coalition’s role, here are the most important takeaways

**A. Municipal bylaws are now “implementation tools,” not “policy tools”**

The province sets the policy. Municipalities implement it. Coalitions must shift advocacy accordingly.

**B. The real battleground is MTSA zoning**

This is where:

- Height
- Density
- Built form
- Parking
- Mixed‑use permissions …are being rewritten.

**C. The OLT is now a central strategic actor**

Coalitions must:

- Track appeals
- Anticipate non‑decision risks
- Prepare evidence packages early
- Understand PPS‑2024 conformity arguments

**D. Recess periods matter**

The government continues to use recesses to:

- Drop major announcements
- Release regulatory changes
- Introduce new housing directives

Your coalition should maintain a recess monitoring protocol.
